These Terms of Service ("Terms") govern your access to and use of PortWarden (the "Service"). The Service is operated by PortWarden, Inc. (a Wyoming corporation) ("PortWarden", "we", "us", "our"). If you have questions, contact Contact Us.
1) What PortWarden is (and isn’t)
- PortWarden provides automated internet exposure monitoring, reporting, and guidance.
- It is not a guarantee of security, and it is not a full penetration test or red team engagement.
- We may offer optional partner referrals for deeper validation, but those are separate engagements.
2) Authorization is mandatory
You may only monitor and scan assets you own or are explicitly authorized to test. You are responsible for ensuring your use complies with applicable laws, contracts, and rules of engagement.
- We may require proof of control (for example, a domain verification step) before enabling monitoring.
- We may suspend or terminate accounts that appear to scan unauthorized targets.
3) Accounts and acceptable use
You agree not to misuse the Service. Prohibited uses include (without limitation) scanning assets you do not control, interfering with the Service, attempting to bypass restrictions, or using outputs for harassment, doxxing, extortion, or other unlawful activity.
4) Reports, artificial intelligence (AI), and interpretations
The Service may use proprietary analysis, including artificial intelligence (AI), to summarize scan outputs, correlate findings to services, and reduce noise from generic software assumptions. Reports and chat responses are provided for informational purposes and may contain errors or omissions.
- You are responsible for validating changes before making production-impacting decisions.
- You are responsible for implementing remediations and verifying outcomes.
5) Service availability and changes
We may modify, suspend, or discontinue any part of the Service at any time. We aim for reliability, but availability is not guaranteed.
6) Payments
If you purchase a paid plan, you agree to pay the applicable fees and taxes. Billing terms, refunds, and plan limits may be described on the Pricing page or in an order form.
7) Intellectual property
We retain all rights in the Service, including software, designs, and analysis methods. You retain rights in your content and configuration, subject to the limited license needed for us to operate the Service.
8) Privacy-first principles (without making impossible promises)
We believe privacy is a right, not a product feature. We minimize collection and avoid unnecessary tracking. Details are in our Privacy Policy and Data Retention Policy.
9) Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
10) Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PORTWARDEN WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
11) Indemnification
You agree to defend and indemnify PortWarden from claims arising from (a) your unauthorized scanning or lack of authorization, (b) your violation of law or third-party rights, or (c) your misuse of the Service.
12) Governing law
These Terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-law principles.
13) Changes to these Terms
We may update these Terms from time to time. If changes are material, we will update the “Last updated” date and may provide additional notice.
